Ontario counties only, Preserve Scenic Perinton Alliance, Inc Issues Strong PERINTON, NY - March 11, 2008 - The Preserve Scenic Perinton Alliance, Inc. ("PSPA")
today announced a call to action to all Perinton taxpayers to voice their opposition
to recent findings that support the expansion of the High Acres Landfill and Recycling
Center ("HALRC"), operated by Waste Management of New York. On March 7, 2008, Perinton
Town Supervisor Jim Smith announced that the town Conservation Board has released its
findings regarding the landfill expansion and the New York State DEC State Environmental
Quality Review ("SEQR"), as well as the significant public input received on the project.
This input was overwhelmingly opposed to the expansion. "Based on our analysis, the PSPA believes the Conservation Board's findings clearly
recommend Town approval of the decades-long landfill expansion plan at HALRC," said
Ken Jentzen, PSPA President. "We are disappointed but not surprised by this based on our
observations of the process and the history of gradual landfill expansions approved by
the Town. The Conservation Board has dismissed each of the public's letters and arguments
made against the landfill expansion, following the same pattern as the DEC." After significant public opposition to the project last May, Waste Management modified
their application to remove any increase in height for the Perinton portion of the project.
They continue to ask for the full height in Macedon and in their application pending with
the State DEC, allowing them to return to Perinton in the future for a height increase. The PSPA is now calling on all Perinton taxpayers, particularly those who bear the
greatest burden of the landfill-those with homes in its immediate vicinity on the eastern
side of town - to attend the following hearings on the subject: Additionally, the PSPA announced today that it has filed an Appeal of a December
decision in State Supreme Court to dismiss its lawsuit against the DEC, Waste Management
of New York and others alleging many shortcomings in the SEQRA or Site Environmental
Quality Review issued by the DEC. The lawsuit, filed in June 2007, was dismissed without
prejudice by State Supreme Court Judge Stephen Lindley. It was the judge's decision that
since the State DEC did not yet issue a permit, the PSPA had not yet incurred any "injury".
The goal of the PSPA is to prevent issuance of the permit and it will continue to vigorously
